Terms of Service

1. Who you are agreeing with
These Terms of Service ("Terms") form a binding agreement between you and DO IT analytics, a sole proprietorship registered in the Netherlands under KvK 70550980 ("we", "us"), regarding your use of the PlantAlarm mobile application and the website at plantalarm.eu (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and accounts
- You must be at least 16 years old to create an account.
- You are responsible for keeping your sign-in credentials confidential and for all activity on your account.
- You agree to provide accurate information and to keep it up to date.
3. Licence to use the Service
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the PlantAlarm app on devices you own or control, for your own personal, non-commercial use, subject to these Terms.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of any applicable law;
- attempt to reverse-engineer, decompile, or extract the source code of the app (except where permitted by mandatory law);
- interfere with the operation of the Service or the experience of other users;
- use automated means (scrapers, bots) to access the Service without our prior written consent;
- upload content that infringes the rights of others or that is unlawful, harmful, or misleading.
5. Your content
You retain ownership of the plants, photos, notes, and other content you add to the Service. You grant us a limited, worldwide, royalty-free licence to host, process, and display that content for the sole purpose of operating the Service for you. We do not use your content to train AI models.
Plant photos you submit for identification are transmitted to the PlantNet API; their use is governed by PlantNet's terms.
6. Plant identification and care reminders are informational
PlantAlarm helps you keep track of when to water and care for your plants and surfaces plant identifications provided by third-party services. The Service is not a substitute for horticultural or botanical advice. We do not guarantee the accuracy of plant identifications or that following a reminder schedule will keep a plant alive. You use the Service at your own risk.
7. Third-party services
The Service uses Google Sign-In, Supabase, PlantNet, and other third-party services. Your use of those services through PlantAlarm is also governed by their own terms and privacy policies, summarised in our Privacy Policy.
8. Changes to the Service
We may change, suspend, or discontinue any part of the Service at any time. Where we make material changes that adversely affect you, we will provide reasonable advance notice in the app where practical.
9. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you in the app and update the "Last updated" date above. Continued use of the Service after the update means you accept the updated Terms.
10. Termination
You may stop using the Service at any time and delete your account via the account deletion page or the in-app settings. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk for us or other users; where possible we will notify you first.
11. Disclaimers
To the maximum extent permitted by Dutch and EU law, the Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. Nothing in these Terms limits your statutory consumer rights.
12. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service is limited to the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or, if the Service was free, to EUR 50. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or damage to your plants.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands. Any dispute arising from or related to these Terms will be brought before the competent court in The Hague, the Netherlands, unless mandatory consumer-law provisions grant you the right to sue in your country of residence.
